Convicted Murderer Asking For New Trial

{Charleston, West Virginia}...In 2008, Desmond Clark chased his girlfriend, Nalisha Gravely, through a crowd of customers inside the Taco Bell on Charleston's West Side and into a storage closet where he fatally shot her at point-blank range. One year later, Clark took a plea deal and was sentenced to life in prison without the possibility of parole. Friday, Clark appeared in court with a new attorney, seeking a new trial. Clark took the stand Friday in his own defense, saying what he did that day was just a mistake, and, if he had not been intoxicated, it would have never happened. Defense attorney Sherman Lambert says Clark's lawyer at the time of sentencing failed to argue the drug use and the alcohol use as a factor. Prosecutors say Clark's killing of Gravely was premeditated, and now he has to face the consequences. The judge will have 30 days to make a decision.
