{Richmond, Virginia}...During a 20 minute hearing Friday, a three-judge panel of the 4th U.S. Circuit Court of Appeals focused on former Upper Big Branch mine security chief Hughie Elbert Stover's claim that there was no evidence he knowingly lied to investigators after the 2010 explosion when he told them that miners were not alerted whenever inspectors arrived. Stover's attorney, William Wilmoth, told the judges that when Stover became security chief at the former Massey Energy mine near Montcoal, he put a stop to the practice of guards telephoning miners to alert them that inspectors were on the premises. Instead, he said, guards announced every visitor's arrival on two internal radio channels, a practice that company attorneys had assured Stover was legal. However, Assistant U.S. Attorney Blaire Malkin said Stover flatly told investigators several times that "we do not notify" when an inspector arrives. She said it was clear Stover knew this was untrue, and it was up to the jury to decide whether he deliberately lied. Stover was convicted last year of illegally ordering a subordinate to destroy documents relevant to the investigation, but the Court of Appeals did not even get to that issue.

Cobalt Coal Seeks Dismissal Of Lawsuit

{Charleston, West Virginia}...Cobalt Coal, the operator of the mine featured on Spike TV’s reality show "Coal," has filed a motion in U.S. District Court in Charleston, asking a judge to dismiss a lawsuit over mining royalties. Encoal Energy and Gopher Land Services sued Cobalt last month, saying they’d signed an agreement with Cobalt in 2010 that gave them 4 percent of the average gross sales price per ton of coal sold, as long as that price remained under $95 per ton. Some months, they say Cobalt made those payments. In others, the payments were made by Westchester Coal LP. But, in May, the payments stopped. Cobalt Coal says federal courts lack jurisdiction because the companies involved are all in West Virginia and that Encoal and Gopher agreed to binding arbitration to resolve disputes.

Brief Supports Mingo Logan Coal Company

{Charleston, West Virginia}...West Virginia filed a "friend of the court" brief Wednesday in the U.S. Court of Appeals supporting Mingo Logan Coal Co. in its ongoing legal battle against the federal Environmental Protection Agency's attempt to revoke Mingo Logan's Clean Water Act Section 404 permit to mine the Spruce No. 1 Mine in Logan County. The U.S. Army Corps of Engineers issued the permit in 2007. Nearly three years later, the EPA vetoed the permit. The West Virginia Department of Environmental Protection had already certified that Mingo Logan's operations complied with state water quality standards and applicable mining regulations. In March 2012, a federal trial court in Washington, D.C. reversed the EPA's veto and criticized the EPA's actions, saying it lacked the statutory authority to revoke the Spruce permit. The EPA appealed the decision. Governor Earl Ray Tomblin says he will not back down until the federal EPA finally acknowledges-once and for all-that it's overstepping its bounds.

Accused Attacker Has West Virginia Ties

Thursday, New York City Police arrested 42 year old David Albert Mitchell on charges that he brutally raped a 73 year old woman in New York's Central Park on Wednesday, September 12th. West Virginia authorities say Mitchell was a person of interest in the 2002 slaying of Barbara Flake in the McDowell County community of Jenkinjones, where Mitchell once lived. An ex-girlfriend, Saretta Mitchell, says he bragged about killing Flake, but investigators never had enough evidence to charge him. Police determined that Flake died from a blow to the head when they found her skull two years after she disappeared from her home. Authorities say Mitchell has been in and out of prison since he was 18. Mitchell served eight years in a Virginia prison for the 2003 abduction of Saretta Mitchell and got out last year. Records show he violated probation three times, then apparently fled to New York. His first felony arrest was in 1989, when he was accused of killing 86 year old Annie Parks of Jenkinjones. Although Mitchell was acquitted in that case, he was arrested again a few months later, charged with raping another Jenkinjones resident who was in her 70s and stealing her gun. Prosecutors dropped the sexual assault charge in that case under a plea bargain. He was released from the Mount Olive Correctional Center in February 2000, but incarcerated again in December 2000 on a grand larceny charge. He finished that sentence in 2001.

Police then learned that Washington had been staying with a woman at an apartment next to the one where police originally looked. As officers were preparing to enter the second building, they received word that Beckley police officers had stopped and arrested the pair on the West Virginia Turnpike. Washington and Daniel Little are accused of fatally shooting 40 year old Raymond Chambliss at a home along Mary Street on Monday and shooting Natalie Sprouse.
