The state Senate is moving quickly on a bill that would make painting graffiti a crime.
The bill (SB 116), which advanced from first to second reading in the Senate Monday, would for the first time outlaw graffiti.
Similar legislation passed last year, but was vetoed by Gov. Earl RayTomblin because of a technical error.
“We do not have a definition for unauthorized markings on buildings and property,” said bill co-sponsor Sen. Evan Jenkins, D-Cabell. “We have a patchwork of ordinances that cities around the state have enacted.
Jenkins says his home city, Huntington , has a particular problem with graffiti and he wants to give police the authority to do something about it.
“It’s not just a big city problem. It is in rural parts of the state as well,” Jenkins said.
The bill makes painting graffiti a misdemeanor crime, punishable by up to six months in jail and a $1,000 fine. A third offense could result in a year in jail and a $10,000 fine.
