Former Upper
Big Branch Mine superintendent Gary May is set to appear in court
January 17th after pleading guilty to charges he
defrauded the federal government through his actions at the mine. Monday, defense
attorney Tim Carrico asked Judge Irene Berger to impose less than the 15 to 21 month
sentence federal guidelines recommend. Assistant U.S. Attorney Steve Ruby said the
federal recommendations don't account for the risk that May's actions created
to miners' lives and asked Berger to consider a sentence above the recommended
range. Former security chief Hughie Elbert Stover is in prison in Kentucky , convicted of
lying to investigators and ordering a subordinate to destroy documents during
the investigation. Former White Buck Coal Co. President David C. Hughart is set
to enter a plea to two federal conspiracy charges on January 16th.
