Lawsuit Re-Filed In Mingo County
{Williamson, West Virginia}...Earlier this year, 22 year old Calvin Jerrod Wilkerson filed a lawsuit in Mingo County Circuit Court alleging that three state troopers, along with officers from other law enforcement agencies called to oversee his forced admission to a mental hospital, repeatedly beat him with batons and kicked him when he refused to be taken to a facility. In 2009, Wilkerson's mother requested a mental hygiene warrant on her son, forcing him to seek treatment at a mental facility. Wilkerson's lawyer, E. Lavoyd Morgan Jr., re-filed the case in federal court this past week, claiming in an amended complaint that the officers violated his constitutional rights. The lawsuit alleges troopers brutally beat him before allowing police dogs to run him down and attack him. According to the lawsuit, Wilkerson began struggling with the officers after he was taken to a law office in downtown Williamson for a hearing, but, when the struggle ended, five officers led him outside, shot pepper spray in his face, and kicked and punched him while he was on the ground. The lawsuit states that the beatings continued after Wilkerson was taken to State Police detachment headquarters in Williamson.
