Murder Charges Against Mingo County Man Dropped

{West Virginia}...Twenty-four year old Justin Lee, of Matewan, in Mingo County, was supposed to go on trial Monday morning in the death of his unborn child, but charges against him were dropped. Police say Lee punched Brittany Adkins, his pregnant girlfriend, in the stomach in June 2010. She went into labor shortly after being hit, and the baby died an hour after being born. Monday, assistant prosecutor Dan Holstein told Circuit Judge Charles E. King the state cannot establish without a reasonable doubt that the assault was connected to the death, noting in particular that medical experts could not conclusively link the incident to Adkins' miscarriage. Lee pleaded guilty to domestic battery. Lee has been in prison since November 11th.
