Teen Charged With Murder...Bond Denied
{Charleston, West Virginia}...James Daughtery, 16, of Charleston, was in court Friday seeking a bond after being charged with the February 2010 double murder of Bruce Duling and Carrie Pontier who were found shot to death in a car along Chesterfield Avenue in Kanawha City. Judge Carrie Webster denied the bond motion but told the defense she would reconsider her decision once they file a "best interest analysis" and prove Daughtery is not a flight risk. Defense filed a motion to dismiss the case, saying it has been 22 months and Daughtery has not had a trial, but has been in jail. The defense claims it's against his constitutional rights to hold him since he's had no bond and been incarcerated without getting a speedy trial. Prosecutors say since he has just been transferred to adult status they now have three terms in which a grand jury can indict him.
