Virginia}...After more than a year of freedom, Joseph Lavigne returned to
prison Tuesday to finish a 22 to 60 year prison sentence after being sentenced
in 1996 for the brutal rape of his then five year old daughter. Lavigne's
daughter, Katie Haught, is now 22 and denies that her father attacked her. The
West Virginia Supreme Court ruled last week that former Judge O.C. Spaulding
abused his discretion when he overturned Lavigne's conviction in May 2011 and
granted him a new trial. At the time, Lavigne had served more than 15 years in
jail. Lavigne will be eligible for parole in 2023. His lawyers plan to appeal.
