Trial In Officer Shooting Postponed


{Charleston, West Virginia}…A trial was scheduled for Monday morning in Kanawha County Circuit Court, but it was postponed until January 24th after a defense psychiatrist told Kanawha County Circuit Judge Carrie Webster that 37 year old Nickey Smith from Glasgow is incompetent to stand trial. Smith is charged with malicious wounding and attempted murder for allegedly shooting Glasgow Police Officer Steve Smith in December 2011. Officer Smith was responding to a call about a burglary at Smith's home with another officer when he was shot. Nickey Smith pleaded not guilty to charges of attempted murder and malicious wounding in August but has already pleaded guilty to federal gun charges connected to the incident. Because is a convicted felon, he was not supposed to have a gun.
