Lawsuit Seeks To Block Boone County Permit

  • {Charleston, West Virginia}...The Ohio Valley Environmental Coalition and other environmentalists filed a lawsuit Wednesday in U.S. District Court, asking Judge Robert Chambers to grant a temporary restraining order that would block a key permit for Loadout LLC in connection to a planned Boone County strip mine. The lawsuit also asks Chambers to consider blocking a permit issued for Loadout's Nellis Surface Mine. The groups are challenging a Clean Water Act permit issued by the U.S. Army Corps of Engineers, claiming the Corps violated a previous court order by failing to re-evaluate the entire Loadout permit and failing to address public comments on its mitigation plans. Loadout is a unit of Pennsylvania-based Penn Virginia Resource Partners.
