Man Sues West Virginia State Police

  • {Charleston, West Virginia}...Criss Alan Heston of Logan has filed a lawsuit in Kanawha County Circuit Court seeking unspecified damages after West Virginia State Police ordered him to register as a sex offender for a 1976 adultery conviction. Heston pleaded no contest in 1976 to misdemeanor sexual misconduct, or adultery, and spent eight days in jail. The lawsuit says the Legislature abolished the crime of adultery in the 1980s, but, in 2010, State Police ordered Hester to register as a sex offender for life or face imprisonment. Heston says he suffered humiliation during his time spent on the registry before a Marion County judge ordered him removed from the list last December.
